This page contains links to information on cases coming before the Planning and Zoning/Local Planning Agency, Hearing Examiner, and/or City Council. The City's Hearing Examiner meets on the first Tuesday of the month.  The Planning and Zoning/Local Planning Agency meet on the first Wednesday of every month. Occasionally, there are special meetings held.

The Planning and Zoning/Local Planning Agency is the recommending body for Future Land Use Map Amendments and Comprehensive Plan Text Amendments.  The Planning and Zoning/Local Planning Agency is also the recommending body for revisions to the Land Use and Development Regulations and Annexations.  

The Hearing Examiner is the final decision-making authority for the following cases: Appeals to Administrative Decisions, Special Exceptions, Marine Improvement Deviations (Docks), Variances, Non-Conforming Structure Special Exceptions (NC SE), Landscape Deviations, South Cape Redevelopment Incentive Program Applications, Non-Residential Design Standard Deviations, and some Planned Development Projects.  The Hearing Examiner is the recommending body for Vacations of Plat, Zoning Amendments, and some Planned Development Projects.

The applicant requests a future land use map amendment from the Lee County future land use designations of RS-1 and Intensive Development to the City of Cape Coral future land use designation of Commercial/Professional (CP). The site is six parcels, totaling 1.02 acres, and was annexed into the City of Cape Coral in 2022.  The amendment is the 2nd step in developing the property within the City. The applicant will also need to apply for a rezone as the last step for future development.

The RPUD area, also known as North Cape Estates, will be a gated waterfront community in NW Cape Coral with 24 single family residential units. The applicants are rezoning the 17.12-acre site from the Single-Family Residential (R1) District to a Residential PUD. They are requesting approval of a master concept plan (MCP) and approval of the proposed uses, densities, and dimensional standards. Additionally they are requesting relief from the following standards. Relief from Section 3.4.7.G.3.c which requires a minimum of 25% open space for PUD’s to allow a total of 16.1% open space. Relief from Section 5.1.8. which requires residential PUDs with 20 units or more to install sidewalks along street frontages, to allow for no sidewalks within this PUD. Relief from Section 3.4.7.G.3.d to allow for a perimeter wall in leu of landscaping between a PUD and adjacent land uses.
